Civil procedure in the Republic of Bulgaria is governed by the Bulgarian Code of Civil Procedure, which systematically regulates the various forms of judicial protection available under Bulgarian law.
If you receive a court document from a Bulgarian court, it is probably an initiating application concerning a claim by a Bulgarian or Bulgaria-resident natural or legal person seeking an order against you.
The party initiating proceedings files the claim and all documents with a Bulgarian court, which serves the claim on the defendant together with copies of the documents filed and their translation. The defendant is invited to present a complete defence within one month of receipt, by filing a statement of defence with all supporting evidence at the registry of the court hearing the case.
The Bulgarian court will examine the written submissions after the defendant enters an appearance and, unless preliminary objections allow the case to be decided without a hearing, will schedule a hearing for the parties.
At the first hearing, the parties' defence positions have already been outlined. The claimant may make further applications and submissions at the hearing arising from the defendant's defence, after which the defendant may reply.
In essence, action must be taken through qualified professionals as soon as a judicial document from Bulgaria is received, so that the necessary defence can be conducted in court and unpleasant consequences caused by failure to respond can be avoided.
