Establishing the claim

Recovering a cross-border debt starts with an examination of the underlying relationship. Contracts, orders, invoices, delivery documents, communications and payments help establish the amount, due date, interest and any disputes. The debtor must be correctly identified, distinguishing the company from its directors or shareholders. The Firm assists Italian and Bulgarian creditors in assessing the documents and available steps, including where an initial payment request has gone unanswered.

Assessing information about the debtor

A favourable enforceable title does not guarantee actual recovery. For this reason, where relevant and permitted, registry and asset checks help compare possible actions with anticipated costs. Any insolvency proceedings, corporate transformations or other factors affecting recoverability must be considered. The objective is to establish a sustainable strategy, preserve evidence and act promptly when deadlines or urgent protection needs arise.

Choosing the procedure

An out-of-court demand can open discussions about payment, security or a repayment plan. Where court action is needed, the choice between national proceedings, a European order for payment and other tools depends on jurisdiction, the claim’s characteristics and foreseeable defences. If a decision already exists, the rules allowing its circulation in Italy or Bulgaria are examined. Each route requires its own documents and formalities, to be coordinated before proceedings begin.

Enforcement and updates

Enforcement must be organised in the State where the assets are located and in accordance with the applicable rules. The Firm coordinates assistance with the locally appointed professional and keeps the client informed of relevant developments. For an initial assessment, it is useful to provide a debt statement, documents concerning the relationship, the debtor's details and any documents already served. Alternatives are compared in terms of practical effectiveness, costs and risks; no outcome can be guaranteed in advance.
